Under the Fair and Accurate Credit Transactions (FACT) Act, financial institutions that share any consumer information with their affiliates for marketing purposes are required to provide notice to their customers/members.
Our Affiliate Marketing Notice (AFMKT-NOT) makes this an easy task. This notice allows customers/members the ability to limit marketing from affiliates. It's written in clear, concise language and addresses all the requirements outlined in the affiliate marketing regulations, including:
- The name of the institution(s) providing the notice
- A list of affiliates or groups of affiliates who would use the information
- A general description of the information
- A statement that the customer/member may elect to limit the use of the information
- A time period of at least five years for the duration of the marketing limitation
(you can also choose not to define a time limit)
- A reasonable and simple method to opt out
